Possession

Up to 3 g lowest prosecution priority

Possession of up to 3 g (or one plant) by adults is officially the lowest prosecution priority since the 2003 ministerial directive — typically no prosecution without aggravating circumstances (public nuisance, minors, near schools). Larger amounts and all sales remain criminal.

Retail Sale

Sale prohibited; CBD tolerated in practice

All sale of THC cannabis is prohibited. Low-THC CBD products are tolerated in practice within EU novel-food and tobacco-law frameworks, but rules remain fragmented and enforcement inconsistent. There is no licensed recreational retail channel.

Social Clubs

Clubs in legal grey zone — privacy essential

Belgian cannabis social clubs (e.g. Trekt Uw Plant, active since 2006) operate without a legal basis through court test cases applying the shared-cultivation doctrine. They have no licences and no protection: discretion, closed membership and confidential member records are existential requirements, not preferences.
